Abstract

From the basic consequences of employee's hiring into a job is the right to receive a salary in return for the work assigned to him Getting a salary in return for the work assigned by an employee is the basic right of employee's entry into a job. In addition to the gross salary , enter in account several increments set by the laws and regulations governing the public office, notably the annual increment, which represents a periodic increase in the salary of the public employee corresponding to number of years spent in his work . This annual increment is accounted with special provisions and estimated among them as established by the legislator in Law No. 12/2010 about labor relations. It is therefore a periodic right that recognize the public employee through the law and automatically attributed to the salary of the employee. He can not be deprived of it , except in certain cases determined by the Libyan legislator such as obtaining a poor degree in the annual efficiency report or by the event of the penalty of deprivation of the annual allowance through a disciplinary board. From this point of view, it is important to study this subject in order to understand the concept of the annual increment and its role in determining the salary of the public employee once he joins the public office or in the case when he is graduating in the ladder of public office through promotion until the retirement. Therefore, it is required to distinguish this increment from other similarities and notify the mechanism of its account.
